Being

hides assets outside of your area. For
years, debt collection agencies and lawyers
have been at a loss when a debtor presents
them with this challenge, since the legal
system offers little support for the
creditor, and all the support for the
debtor.

elsewhere. A debt collection agency is
taking a big chance when it refers business
in another area to a collector it has never
used before. Unfortunately, 98% of agencies
are comprised of a room full of mildly
educated intimidators who are rendered
powerless if your debtor is the least bit
versed in local laws. Granted, this has been
an effective way to collect smaller debts,
but the tendency is that the larger the
debt, the better educated your collector

Repossessions
Repossessions
are something we all prefer were not necessary
however when a lender makes a loan they are aware
that there is a risk involved in securing payment of
the loan therefore the collateral is pledged and
used as security. When the account becomes
delinquent all efforts are made to collect or handle
the account in any manner except repossession. A
repossession is the last effort and the last result
a creditor wants or needs.
All too
many people are unaware that when a lender makes a
loan that by Federal regulation they must have a
like amount in " reserve " to guarantee to
that several major loans failure's do not cause a
financial institution to fail. Bad loans can destroy
an institution and even an entire economy.
If an
account falls delinquent collection is started and
as a last resort the debtor is asked to return the
collateral so the collateral can be liquidated and
the loan satisfied.
IF NO OTHER
AGREEMENT can be made repossession is used to
finalize the account.
In about 95
percent of the cases the lending institution takes a
severe loss on repossessions. When an automobile is
repossessed it is disposed of by law. All proceeds
are applied to the balance and any excess is BY LAW
returned to the debtor.
The reverse
however is that in 95 percent of the cases the
collateral brings far less then the amount owed and
in that case the loss is suffered by the creditor.
This is usually the case.
