The perils of ediscovery…

Think of how many emails get transmitted daily. The multiply that by the number of employees in a company, then multiply that by the myriad of different types of file formats, applications, hardware configurations and then you start to get an idea of the leviathan that is ediscovery.

Often, the old saying “trying to find a needle in a haystack” becomes a harsh reality for a computer forensics examiner. This used to cost litigants vast sums of money because it often required teams of people sifting through massive amounts of paperwork. Technology helps, but it can only go so far to determine the importance of a particular piece of data. And it’s not just email messages, every single document – regardless of its origin is subject to discovery and thus subject to being examined and searched. This also holds true for voicemail messages. When litigation begins  everything is fair game.

An interesting article appeared on this very subject recently. You can read it here.

  1. It is amazing how many people don’t realize the variety of communications that become subject to discovery when they chose litigation. Thanks for posting this.
